Welcome to the December edition of The REACH Centre newsletter.

As 2009 draws to a close, we can reflect on what has been a busy year for the industry who have been coming to terms with working together in order to comply with the sometimes complex REACH regulation.

2010 offers a new set of challenges to everyone involved in the Registration process, with the first deadline for some companies due at the end of November. This is alongside other developments including the ever increasing amount of substances due to be added to the Candidate List for Authorisation and the burden of the new Classification, Labelling and Packaging legislation.

As the end of this month provides us all with an opportunity to take a break, The REACH Centre will be closed between December 24th and January 4th while we all enjoy the calm before the storm! REACH News Update
ECHA ADDS 15 MORE SUBSTANCES TO REACH CANDIDATE LIST FOR AUTHORISATION

ECHA's Member State Committee has identified a further 15 chemical substances to be added to the Candidate List of substances of very high concern.

ECHA is due to formally update the candidate list in January 2010, bringing the total number of substances on the list to 30.

Manufacturers and importers supplying products containing SVHCs on the candidate list have mandatory requirements to declare SVHCs in products present in concentrations of 0.1% by weight within 45 days of a request for SVHC information by a consumer.

The authorisation process will seek to ensure that the risks from Substances of Very High Concern are properly controlled and that the substances are progressively replaced

ACTIVE LEAD REGISTRANTS UPDATE

By 2nd December 2009, 2072 SIEF lead registrants have been notified to ECHA. You can download this PDF and check whether your SIEF is progressing and has appointed a lead registrant.

The role of Lead Registrant is laid down in REACH and it is mandatory for each SIEF. Lead Registrants preparing for the 2010 registration deadline are advised to inform ECHA of their nomination by clicking here.


FORUM DECIDES ON CHECKING HOW FORMULATORS COMPLY WITH REACH

The Forum for Exchange of Information on Enforcement has decided to focus its next joint REACH enforcement project on formulators of mixtures, who are the first level Downstream Users in the supply chain. This project is a natural continuation of the ongoing enforcement project on manufacturers and importers.

Most mixtures are sold to article producers but a large number are sold directly to consumers such as detergents, paints and personal care products. The preparations of the project will start early 2010 and the on-site inspections are scheduled for 2011 after the first registration deadline.

The current REACH enforcement project, REACH-EN-FORCE1, will finish at the end of this year. Preliminary results indicate that 850 inspections in total have taken place in 28 countries. Inspectors in the participating countries focused on the phase-in substances (existing substances) and checked whether manufacturers and importers have pre-registered or registered their substances. In addition, Safety Data Sheets were inspected. A summary report of this project will be published in spring 2010.


REACH news in brief

  • UK RETAILERS BREAK INFORMATION RULES ON SUBSTANCES OF VERY HIGH CONCERN
    • Major retailers, including John Lewis and Focus are failing to comply with information rules regarding the use of hazardous materials in some of the products they sell, a new report has found. Click here for more information

  • A NEW VERSION OF IUCLID 5, IUCLID 5.2, WILL BE RELEASED DURING THE FIRST QUARTER OF 2010, PRESUMABLY IN FEBRUARY.
    • A number of modifications, corrections and enhancements will be made in the new version. To upgrade to the new version, the data must be migrated because the data model of IUCLID 5.2 differs from that of the previous versions. To facilitate the migration from IUCLID 5.0 and 5.1 to IUCLID 5.2, a ‘back-up plugin’ will be released.

  • REACH-IT TO UNDERGO MAJOR UPGRADE DURING CHRISTMAS BREAK
    • ECHA will use the Christmas break for a major upgrading of the REACH-IT submission system, which will be closed from lunchtime of 14 December 2009 to 3 January 2010 inclusive. The Helpdesk and ECHA’s offices will be closed from 24 December to 3 January inclusive. By lunchtime of 4 January 2010, REACH-IT will re-open and be available for submissions 24 hours a day during the working week – from 8.00 Monday until 19.00 Friday


Focus on: IUCLID

IUCLID5 (International Uniform Chemical Information Database) is the official tool for data collection in relation to REACH and is essential for those looking to successfully register in line with REACH.

Unfortunately many companies do not realize that every registrant, including joint registrants, will have to use IUCLID5 to submit a registration dossier.

Data that can be compiled and maintained by IUCLID includes:

  • information about the legal entity submitting the dossier
  • general information including chemical name, CAS number, impurities
  • classification and labelling information
  • physical-chemical data (e.g. melting point)
  • environmental fate
  • toxicologial properties (e.g toxicity to mammals, carcinogencity)
  • eco-toxiocological properties (e.g. toxicity to marine life)

A dataset entered into IUCLID can be used to create a registration dossier for REACH registration, but the standard XML format used by IUCLID means the data stored in the system can also be accepted under other chemical legislation and programmes including the OECD HPV Chemicals Programme and the EU Biocides regulation.

News from The REACH Centre

THE REACH CENTRE HELPS RUSSIAN OIL GIANT

Simon Brearley, senior consultant at The REACH Centre, recently presented a REACH Seminar for employees of Lukoil Oil company in Perm, Russia. The seminar was arranged by Venelin Marinov of Lukoil’s Bulgarian subsidiary Lukoil Neftochim Bourgas, who are acting as Only Representative for Lukoil’s non EU operations. Venelin has been attending Lancaster University’s Postgraduate Certificate of Competence in REACH Registration and felt that his colleagues in Russia would benefit from a better understanding of the requirements for successful REACH registration.

The event was held over 3 days in Perm, home of one of Lukoil’s largest petrochemical complexes during which Simon presented sessions on chemical safety assessment and safety data sheet requirements. Commenting on the event, Simon said "the language difference was the main challenge as the presentation had to be translated sentence by sentence so it important that the slides which had been translated into Russian where carefully scripted to provide the detail the audience required."

DR ALFONSO INFANTINO COMPLETES INTERNSHIP AT THE REACH CENTRE

Dr Alfonso Infantino has completed his internship at The REACH Centre. He has been working closely with our scientific and regulatory team over a number of months to provide his expertise to the industry in complying with the Pesticides Directive and with the new REACH Regulation, mainly in developing Exposure Scenarios.

Alfonso is an expert of fate and behaviour modelling currently working at ICPS (International Centre for Pesticide and Health Risk Prevention) in Milan. The institute carries out the evaluation of dossiers submitted to the Italian authorities under the Pesticides Directive (91/414/EC).






NEW DATES ANNOUNCED FOR ACCREDITED REACH COURSE

Lancaster University have announced new 2010 dates for their popular Postgraduate Certificate of Competence in REACH Registration.

Due to the success of last year's course, it will be run again in early 2010 giving more people the opportunity to develop an in-depth understanding of the REACH regulation.

The course consists of 3 modules each lasting 3 days focussing on aspects of REACH that are necessary in understanding and interpreting the regulation and the scientific and technical information needed for registration. Flexible study options are available and delegates can study individual modules as appropriate to specific requirements.

THE REACH CENTRE TO PRESENT AT iSMITHERS 'MANAGING SVHCS UNDER REACH' CONFERENCE IN BRUSSELS

Sandra Meijer of The REACH Centre is due to present at the 2010 'Managing SVHCs under REACH' event run by iSmithers in Brussels on Wednesday 27th January 2010.

Sandra will present 'Strategic approaches for managing SVHCs in the supply chain' during the morning session, and lead a pre-conference workshop 'Managing SVHCs in the Supply Chain – Practical Advice & Case Studies' on Tuesday 26th January between 2.00pm and 5.00pm.

This half day workshop will provide accurate information on REACH requirements for SVHCs, together with practical advice on compliance and management that can be applied by the participants in their own business setting. Participants will be invited to actively contribute to the various areas under discussion, drawing on their own issues and experiences. Throughout the day, the different themes will be illustrated using a variety of case studies, giving participants a unique opportunity to learn from real-life situations.

JUST WHAT THE DOCTOR ORDERED!

Chemical Northwest's new REACH Clinic have proved a resounding success in supporting industry over the last few months, so much so that it is intended to extend the programme through 2010 up to the first Registration deadline in November.

The REACH Clinic is delivered by The REACH Centre at a variety of locations across the Northwest of England, and provides companies with access to a free expert consultation on REACH and related chemical regulations. Key topics covered to date have included REACH registration strategies, SIEF/consortia communication issues and implementation of the complex new CLP regulations.

The workshops are free of charge to companies based in the Northwest of England.

As Phil Wallace, MD of Wallace FR and one of the beneficiaries of the programme, explains, "We are one of the leading providers of speciality flame retardants worldwide. Key to our success is providing our customers with a solution that is often required to meet stringent performance levels. Classification, Labelling and Packaging: your legal obligations

Date - Thursday 11th February 2010
Venue - Lancaster University Campus
Cost - £295 + VAT per person

This course is designed to introduce you to the new Classification, Labelling and Packaging (CLP) Regulation (Regulation (EC) No 1272/2008) which sets-out the new requirements for the classification, labelling and packaging of chemical substances and mixtures. The Regulation came into force on 20 January 2009 and some requirements impact on businesses immediately whilst others come into effect in the future. The CLP Regulation implements the Globally Harmonised System for the classification and labelling of chemicals (GHS) in the EU.

The course is presented by Andrew Fasey who was a member of the IOMC (Inter-Organisational programme for the sound Management of Chemicals) drafting group which prepared the GHS.

During the day you will have the opportunity to interact with other delegates and the presenter, and discuss issues surrounding the CLP regulation and how to plan for and implement it within your company.

SVHCs and REACH

Date - Wednesday 3rd February 2010

SVHC (Substances of Very High Concern) are a diverse group of substances that have been placed in the candidate list of substances considered for Authorisation by the ECHA because of their particularly hazardous properties. Due to the specific hazards associated with these chemicals REACH imposes controls on them over and above those that apply to standard chemicals.

This workshop will provide chemical users and suppliers of articles with all the information they need to comply with REACH in respect of SVHC and to assess the business and commercial impact of these substances. The day will be kept to a maximum of 20 participants to allow questions and interaction with our REACH specialists.
